This session reviews recent LTD litigation and offers design approaches that will optimize benefits and minimize litigation and costs.
Long-term disability (LTD) benefits appeals and litigation is at a level disproportionate to the number of claims. Defending against these appeals and litigation generates substantial administrative and legal costs. You will learn the benefit features most vulnerable to claims and appeals, such as the definition of disability, the timeframe for submitting claims, appeals and initiating litigation. You will be able to identify the most effective contractual language around the definition of disability, the condition diagnosis and the vocational assessment. This session will help you gain an understanding of the options for reducing those exposures.
