Learn how to spot legally protected complaints by employees and effective methods of addressing such complaints to avoid whistle-blower lawsuits. 

This session will address the expanding types of employee complaints, or “legally protected activity,” for which employers may not retaliate and will identify effective internal policies to address the complaints. The session will address appropriate employer responses to internal complaints and the types of evidence that employers can develop to enhance their ability to avoid lawsuits and defend themselves should an internal complaint proceed to litigation. You will learn:

  • About trends in employment litigation concerning the types of employee complaints that form the basis for lawsuits.
  • About drafting internal policies to address internal complaints and effective responses to complaints either to resolve them before a lawsuit ensues or to enhance the chance of successfully defending a lawsuit for alleged whistle-blower retaliation.
